My Daughter Got Lead Poisoning Through Toy Made In China Should I Sue?

I am wondering what the precedence is of companies like Wal-Mart that have knowingly sold products that and marketed unsafe items from ? It is a fact that Wal-Mart has had prudent knowledge to believe that these products are unsafe and more then 10 million people have been exposed to cancers causing chemicals as a result.
Big Imports companies and their rich executives have long failed to notify their customers of the dangers associated with foreign goods by labeling or using prudent discretion in purchase of them.

  1. yes! you can sue!
    first, check and make sure you hang on to the toy for evidence
    then, you need the receipt. make sure to make a copy. then you need a signed medical record from the doctor’s office vouching your daughter is effected by lead poisoning. then, read the brand name of the toy, contact that company and sue the hell out of them!

    we need to put these greedy half @ssed profit driven american companies out of business before they poison us all!

  2. Unless they knew with certainty that the exact product was dangerous, and you can prove that they were negligent in selling the product (by showing that they sold it to you after it was recalled, for example) then you likely have little basis to do so.
    Anything made with plastic causes carcinogens, which can cause cancer. So actually, there are really a ton of products sold to us daily that can cause cancer. But it’s considered common knowledge that carcinogens cause cancer, and many chemicals used in common goods (made in both foreign and local shops) contain said carcinogens. Unless you can prove that the US gov deemed it an unsafe product and illegal to sell, or that the product was recalled as it was unsafe to sell, then the only person you would really be able to sue is the manufacturer themselves, which of course is a company in China.

  3. When I shop at Wal Mart, I try to be an American. If it says made in America, then I buy it. You should have known better than to buy a toy made in China. Lead poisoning from China has been in the news for many years. If it was me, my first priority would be my daughters health, not how fat my wallet can be through a law suit.

  4. go for it but it wont end for 15 years and by the time you win your lawyer and team will take 85% of the proceeds. So really whats the point?

  5. Did you know about this prior to purchasing the toy? Do you have facts from the doctor that indicates it was from this toy?

  6. If you had a fair idea that Wal-Mart knew their was something wrong with the toy, why did you buy it for your child in the first place?
